Jennifer Elko is certified in Healthcare Compliance (CHC), Healthcare Privacy Compliance (CHPC) and in Healthcare Research Compliance (CHRC). Ms. Elko assists organizations in the development, implementation, and maintenance of compliance programs. She also conducts comprehensive compliance program reviews for a variety of health care organizations, analyzing organizational compliance with the seven elements of an effective compliance program as set forth by the Department of Health and Human Services (HHS) Office of Inspector General (OIG). Ms. Elko works with executives and senior management at these organizations, and provides findings and recommendations to improve the operation and development of their compliance programs. She may also assist these clients in developing and implementing risk remediation plans. Additionally, Ms. Elko provides advisory support services to clients, researching and providing solutions to compliance issues as they arise.
For clients under Corporate Integrity Agreements (CIAs) with the OIG, Ms. Elko has completed Independent Review Organization reports and independent evaluations required under the CIAs. These evaluations include reviewing physician arrangements for compliance with the federal Anti-Kickback Statute and Stark Law. She has also reviewed the marketing and enrollment related contractual, statutory and regulatory requirements for Managed Care Organizations (MCOs). Further, Ms. Elko has experience reviewing and assessing internal marketing and enrollment policies, procedures and training programs that have been implemented to meet these requirements.
Ms. Elko has specific expertise in assessing provider compliance with the Anti-Kickback Statute; Stark Law; Fraud, Waste and Abuse laws; the False Claims Act; HIPAA Privacy and Security Rules; and clinical research laws and regulations. Ms. Elko has experience working with a variety of health care organizations, including hospitals, health systems, physician practices, long-term care organizations, skilled nursing facilities, independent clinical laboratories, and MCOs.
Previous Work Experience
Ms. Elko previously worked as a prosecutor for the Medical Prosecutions Unit of the Illinois Division of Professional Regulation, prosecuting licensed physicians accused of professional misconduct. As a prosecuting attorney, Ms. Elko was responsible for interpreting state licensing laws and regulations.
